DOT SAP Services in Pennsylvania (Return-to-Duty Evaluations)

  • A DOT SAP evaluation is a required assessment for DOT-covered employees who violate DOT drug and alcohol testing rules. After a violation, you cannot return to safety-sensitive duties until you complete the SAP evaluation, follow the SAP’s education/treatment recommendations, and progress through the required RTD steps. 

    During the evaluation, your SAP reviews:

    • the DOT violation circumstances

    • substance use history and related risk factors

    • clinical and functional considerations that affect safety-sensitive work

    Then, the SAP creates a customized education/treatment plan and outlines what must be completed before RTD eligibility can be determined. 

  • SAP services apply to DOT-regulated, safety-sensitive roles, including (but not limited to):

    • CDL/commercial drivers (FMCSA)

    • other DOT-covered transportation roles (depending on your DOT agency)

    If you tested positive, refused a test, had an adulterated/substituted sample, or had an alcohol result meeting the DOT violation threshold, you’ll generally be required to complete the SAP/RTD process. 

  • While each case is individualized, the DOT RTD process typically includes:

    1. Removed from safety-sensitive duties

      A DOT violation triggers removal from safety-sensitive work until RTD requirements are met. 

    2. Initial SAP evaluation

      You meet with a DOT-qualified SAP to complete your assessment and receive a written plan.

    3. Complete the SAP-required education/treatment plan

      This can include education, outpatient counseling, support groups, or other recommendations based on your evaluation.

    4. Follow-up SAP evaluation (re-evaluation)

      After completing requirements, you return to the SAP to determine RTD eligibility.

    5. Return-to-duty testing

      The employer must ensure an RTD test occurs after SAP compliance is documented, and you must have required negative results before resuming safety-sensitive duties. 

    6. Follow-up testing plan

      SAPs set a follow-up testing plan; DOT rules require at least 6 unannounced tests in the first 12 months, and follow-up testing can continue for up to 60 months. 

    7. Employer makes the return-to-work decision

      Completion of the SAP process does not require an employer to reinstate employment; the employer decides whether to return you to duty.
